The Buyer and Seller Agency Agreements continue to evolve as industry organizations strive to protect the interests of both clients and agents while ensuring compliance with the principles set forth in the NAR settlement.
Below are excerpts from the New Jersey Realtors Exclusive Buyer Agency Agreement, comparing a late 2024 version with the most recent update.

In the previous version, buyers were given the option to exclude certain listings, primarily to avoid properties that did not offer buyer agency compensation. However, this approach conflicted with industry best practices, which prioritize presenting buyers with the broadest range of suitable properties.
Additionally, it placed undue influence on sellers’ commission offerings, rather than focusing on the fundamental goal—helping buyers find the right home.
The updated version aligns more closely with best practices by emphasizing the property selection first, with commission negotiations addressed within the offer process.
